If swinging the U.S. flag at a cop is prosecutable as "assault with a deadly weapon", attempting to use an SUV as a battering ram is most definitely assault with a deadly weapon.

Tao Of Freedom's avatar

This is the problem ... Left wing messaging from the mainstream media and utterings from the rabids & co like the Squad endorses and promotes absurdities and your comparison of flag waving to battering ram is valid; that said I doubt that this poor woman had any intent other than to flee the scene ... at the same time ICE agents must be on edge and expecting to be attacked at any instance given once again the Left wing messaging ... tragic ...

Jeff Keener's avatar

I'm sure you're right. Renee Good wanted to get out of there and panicked, ignoring lawful orders, she gunned the engine without consideration of consequences. Evidently, that ICE agent had been dragged ~100 yards by an illegal trying to escape in a vehicle six months ago. Required 33 stitches. Strong motivation to not let that happen again.

bean's avatar

I don't think she panicked. Her wife was out of the car filming it. They were having fun.

Jeff Keener's avatar

After watching the most recent video, taken by the ICE agent, I think you're right. Her wife shouted at her to "Go, baby, go!" and then she tried to speed off. It's like they thought this was a game.

Faith's avatar

Yes, after watching the bodycam video, she was calm and didn't seem to realize the peril she put herself in.

Juju's avatar

I believe she intended to cause harm, not death, but she had no qualms about it if an agent were harmed. At no time when I am driving a vehicle do I ever charge forward if human bodies are nearby. It’s obvious that a myriad of things could go wrong and someone could get hurt. In the situation she was in it’s triply dangerous to smash the accelerator for any reason.

The main issue here is she was purposefully blocking ICE traffic to interfere with their duties, and disobeyed the orders of law enforcement. Had she obeyed their directives she would be alive. Her choice placed her in a position of her own making.

Justin Lillard's avatar

When did the flag waving result in a charge of assault with a deadly weapon? Is this some detail on the Babbit case (or some other J6 protestor)?

Jeff Keener's avatar

"Over 608 defendants have been charged with assaulting, resisting, or impeding law enforcement, with 174 involving deadly or dangerous weapons.

Weapons used during the riot included chemical sprays, tasers, knives, and makeshift items such as furniture and flagpoles." -- https://www.jan-6.com/post/doj-releases-updated-statistics-on-charges-guilty-pleas-convictions-sentencing-in-the-january-6t

Free Will's avatar

So, it's possible that the peaceful patriots on 1/6 were just defending themselves from Swamp Thug cops? One of the weapons was "a spear without a point," aka a stick.

Odd that zero Swamp Thug Cops were killed or seriously injured by protesters on 1/6. Zero. 72 ICE agents have been "attacked with lethal force" over the past year. Seven nearly died.

Thanks for the enlightenment!

I don't care if she was anybody's definition of "armed". She's dead cause she was a dumbass. Good riddance. One good way to not be dead is to not be confrontational with law enforcement. She didn't get that memo, I guess.

rpmschevy's avatar

No not “good riddance”. It’s a tragedy that sits in Democrats door. It’s the intolerant so-called progressives with bloody hands. It’s sad and horrible to see someone die due to ignorance. We shouldn’t want to see anyone die because so-called elites are lying to those so easily manipulated. We need to keep trying to educate and call Democrat politicians out.

spingerah's avatar

Go ahead turn the other cheek, be the " bigger man" the leftists just want to hold hands & sing kumbaya with you while they take your children as their own to do as they please with.

Good luck with that.

rpmschevy's avatar

Try reading. Educating those who lack is not “turning the other cheek”. Clearly my post doesn’t even close to implying your post whatsoever. Try a bit of common sense and reading comprehension. Such an odd reply.

Physically small in stature, Babbit posed zero threat to the capital police officer who shot her as she was trying to climb through a window. A woman driving a 2 ton SUV straight at you is a life or death situation so you react to save your own life. Nothing comparable about the two situations other than neither woman had a firearm. Bad comparison Sasha.

Faith's avatar

And there were several police pointing guns at Ashli Babbitt per the video----only one freaked and shot her.

During the administrations of

Bush, Obama and Biden, Grok AI informs that 10 million undocumented immigrants were deported. I do not recall any widespread opposition or citizens around the protesting and interfering with those making arrests. ICE as such did not exist then and came about after 9/11 when the Department of Homeland Security was established. Citizens have the right to protest but not to interfere with the ICE officers carrying out their duties. This is a slippery slope because political leaders are resisting by declaring “ sanctuary” cities and preventing local law enforcement from cooperating with Federal law enforcement.

John Pizzo's avatar

and affirmatively calling protesters to resist, to 'struggle.' Both are incitements to violence I just don't understand why the DOJ does not arrest and charge those politicians who are aiding and abetting illegal aliens to help them remain on the USA --- -- which is a felony under federal law. It couldn't be any clearer or more definitive. What is Pammy waiting for? In any case, this is the most serious challenge to the rule of law that I've seen in my lifetime.

Wade E Charnock's avatar

These so call protestors are professional at what they do...find the money and turn it off and these phony losers will vanish...they don't care about America that much...they are paid to do what they do!!

Bill G's avatar

Yes. The incitement to violence that these elected officials are employing and encouraging is despicable.

Wade E Charnock's avatar

Arrest Walz and Frey...both are leading an insurrection against the American people...

Seymour De Witt's avatar

Thanks. I understand your thinking but any such action against elected officials would bring on all manner of accusations against DJT's administration. To better ensure results in the mid-term elections, we must not play into their hands. If voters (and I know many) haven't recognized that he's an activist chief executive, they will never change their mind today, tomorrow or ever. In the first year, DJT has carried out some very impressive actions - secured the release of the hostages that Hamas held for 2 years; achieved a "cease fire" in Gaza and the development of a reconstruction for it; in concert with the Israelis, the USAF bombed the Iranian nuclear facilities; and just carried out a precise and successful arrest of President Maduro and his wife who were wanted on a warrant issued by the Biden administration. DJT's administration is trying to turn the tide of "socialism" espoused by Bernie Sanders, AOC and Mamdani. BTW, I noticed that President Trump is referred to by his surname while AOC and others get the initials as a sign of admiration by the MSM. So, it's DJT for me!

I don't personally agree with it, but sanctuary cities have legal footing for refusing to assist ICE since immigration falls under federal jurisdiction, and the Constitution forbids the federal govt. from compelling states and cities from enforcing federal law. What counts as assistance can of course fall into a gray area. However, no one, whether a state, city, or individual, has the right to obstruct federal law enforcement. This is probably why there's been such a coordinated effort to claim that Renee Good was a "legal observer".

OverFlowError's avatar

The state has a legal, indeed, constitutional obligation to keep federal roadways and federally funded roads open to traffic and use by federal officials. Effectively, the local LE in Minnesota and other states where ICE is operating have permitted protesters to block federal LE from traveling on state and federal roads. The DOJ should consider seeking an affirmative injunction directing state and local LE to keep the streets open for federal use.

Faith's avatar

Are you an attorney?

Epaminondas's avatar

I'm not an attorney. I was curious myself why sanctuary cities were even allowed in the first place in the US, so I researched the issue in the past and found the following online:

Printz v. United States: federal government cannot compel state and local officials to carry out federal regulatory programs, including immigration enforcement.

New York v. United States (1992): Ruled that the federal government cannot "commandeer" state governments to enact or enforce federal laws, applying to radioactive waste disposal but setting a broader federalism precedent.

Murphy v. NCAA (2018): Prevents the federal government from ordering states to stop enacting or repealing laws, further protecting state autonomy.

Fourth Amendment & ICE Detainers: Courts have ruled that requiring local law enforcement to honor immigration detainers (requests to hold individuals for ICE) can violate the Fourth Amendment if they lack probable cause, as established in cases like Jimenez v. Napolitano.

San Francisco v. Trump (2021): The Supreme Court dismissed a challenge to San Francisco's sanctuary policies, with a lower court already confirming the city's ordinances were lawful and invalidating conditions that would deny federal funding, reinforcing local control.

Faith's avatar

https://www.youtube.com/live/4t7JgpcOjXE?si=Lh9vZ8ioWIptg-1s Matt Taibbi researched Sanctuary cities and they go back to the 1970s when immigrants were allowed in because we were waging war in El Salvador, etc. Its about 2/3rds of the way through their show. Thanks for your thoughtful reply.

Faith's avatar

I never understood how it was legal to buck Federal immigration law and call yourself a Sanctuary City to begin with. We should have dealt with it then. Now we have a rebellion - a real insurrection by political leaders in Minnesota who think they're justified disobeying Federal law.

She was armed with a vehicle

Texyz's avatar

Oh yeah, like a Mooslim street marauder, she was armed.

Perry Klein's avatar

She was armed with a vehicle, it’s the only reason she’s dead right now, she drove a vehicle toward a police officer, hit that officer, and he shot her as she was shoving him with her vehicle. It’s been sop for LEOs for years to use deadly force against perps using vehicles agains officers or other individuals.

Deidre K's avatar

I agree she had a weapon which she has been using all along. Also,as you probably already know the officer had recently been dragged 300 feet by a rioter needing stitches. I imagine he would have felt in danger.

Michael Pergola's avatar

All arms (in the gun sense) are weapons but not all weapons are arms .

Jay DeLancy's avatar

You're playing into the Democrat narrative by calling the woman driving a car toward anybody "unarmed."

William C Carlson's avatar

Your reader is correct. Terrorists have used cars as weapons in Wisconsin, Germany, and Nice, France. Many, many horrible deaths.

Legal Precedent: Courts have recognized that vehicles, due to their mass and potential for damage, can be used as weapons, even if not designed as such, notes this article from the Office of Justice Programs and the Daily Commercial.

John Pizzo's avatar

.......and this savage cop shot her for no reason; you know, like Michael

Byrd did when he saw and shot unarmed Ashli Babbitt without warning.

when she entered a doorway. Ah, but that's another story, right?'

Democrats gave him not one, but two promotions, after he murdered her.

This is just one example of how media Journalists liars operate and deliberately misconstrue reality to boost their Democrat masters.

Clearly, if you choose to believe these liars, you would be choosing to believe this dead woman was just an unfortunate and innocent victim of Trump's heinous ambition to follow the law and protect the American people from the lawless millions that Joe Biden and the Democrats brought here to replace the millions of Americans who have left the Democrat party as its Overton Window shifts and slips into socialism and the reliable horrors that socialism brings wherever it is tried.

I won't go as far as saying this woman 'deserved' to die, but her outlaw activity to use her SUV to block ICE from doing its lawful law enforcement work and then later, attempting to kill one of the officers who tried to stop her.

I don't blame this woman. After all, trying to kill law officers is a pretty dangerous avocation and one that will likely lead to what we saw happen

yesterday.

I will blame Democrat politicians who are given platforms and microphones

that encourage violence, looting, arson, and all manner of bad manners,

Until they tell protesters to knock off the physical attacks on law enforcement

folks doing the job of cleaning out the criminals and other d deportees that have zero business being present in our country. Until Democrats stop aiding and abetting criminals, the violence will accelerate and more people,

both criminals and cops, will die.

Lastly, why doesn't anybody point out, when making their reports, that Joe Biden and the radical leftists who controlled him, are the CAUSE of the ICE enforcement activities? Why are they not being charged for their SOLE responsibility in creating this crisis? The RICO statute certainly applies

to the Democrat Party, its media minions, and the rest of the BMC

(Bullshit Manufacturing Complex)

Tom Concannon's avatar

Sasha, yes a car is a weapon, obviously. More importantly there has been a leftist insurgent training regimen, over the last ten years particularly, that teaches to use non weapons as weapons. Cars? “Hey I was just driving somewhere”… cracking heads with skateboards? “That’s just my transportation”. Swinging bicycles at people? “Just riding home”… hitting people in the head with paper cups filled with concrete? “I thought it was a milkshake”…. So, an organized effort to cause mayhem using non-weapons and a constant drumbeat of “resistance” and “sanctuary city” rhetoric from Democratic politicians. It’s a horrible look. The concept of sanctuary is a nullification of Federal immigration law. Nullification was adjudicated during the Jackson administration in the 1830s. The concept had no merit.
